CONTRACT FOR LEASE OF MOBILE STORAGE UNIT
THIS LEASE agreement is made this the day of , 20 , by and between KHM Properties, LLC d/b/a EM Storage (hereinafter: Lessor) and (name) (address) (telephone number) (hereinafter: Lessee). In consideration of the mutual covenants contained herein, the parties agree as follows:
Article I- Lease of Storage Space
Lessor hereby leases to Lessee mobile unit number to be located at (address), property owned, rented or leased by the Lessee. There shall be no removal of the unit to any other location unless with the express written consent of the Lessor during the period of this lease.
Article II- Rent and Default
Lessee shall pay as rent for the leased mobile unit $ per month, to be paid on the day of each month. In the event of nonpayment when due of any installment of rent, access to the unity may be refused to Lessee until such rent is paid in full. All property remaining in the unit shall be subject to a lien for the amount of rent in arrears, late fees, labor or other charges, present or future, in relation to the personal property and for expenses necessary for its preservation or expenses reasonably incurred in its sale or other disposition. Property stored in the leased space may be sold to satisfy the lien if the occupant is in default continuously for a period of fourteen (14) days. Lessor may enter onto the property of the Lessee to retrieve the mobile unit in case of default of the Lessee and at the expiration of this lease.
Article III- Right of Entry
Lessor shall have the right to enter the premises upon which the mobile unit is located and inspect the mobile unit at any time for any purpose.
Article IV- Risk of Loss Lessee shall be responsible for all damage or loss of the mobile unit itself as well as assume all damage or loss of any merchandise or goods located in or about the unit from any cause whatsoever and for all damage or loss that may arise from delivery, receipt, piling, stacking or handling the goods or merchandise of Lessee, at all times the mobile unit is in possession of Lessee.
Article V- Jurisdiction and Venue
It is agreed that this lease agreement shall be governed by, construed, and enforced in accordance with the laws of the State of Mississippi. No matter where the mobile unit may be situated, any litigation concerning the terms herein shall commence in a court of competent jurisdiction in the County of Tishomingo, State of Mississippi.
Article VI- Insurance
Goods stored in the unit are not insured by Lessor nor do the storage rates set forth herein include the cost of insurance. If Lessee desires insurance on such goods, he or she must arrange for such insurance through Lessee's own agent or broker and at Lessee's expense.
